Cuenta Propia modification: does your case qualify?

A Cuenta Propia modification is a switch from the digital nomad visa, startup visa or another permit to self-employment in Spain, without leaving the country and without a visa. If you have lived in Spain for a year and your current permit allowed you to work, the new permit is issued for four years at once. You need a reason to switch, a business plan and funds to live on — there is no income threshold.

Condition 1 · A year in Spain

  • At least a year as a resident — on one card or several in a row, without gaps.
  • The year counts from decision dates, not from entry or from getting the plastic TIE card.

Condition 2 · Right to work

  • Your current permit already allowed work. The digital nomad visa (as autónomo) and the startup visa qualify.
  • Non-lucrative residence and employment by a foreign company do not: one year first, four at renewal.
ℹOne detail about dates. If your old card is still valid, the new permit starts on the filing date; if it has already expired, on the day after it ended. The waiting months are not lost, and filing early does not shorten your new card.

A reason to switch: wanting to isn’t enough

For holders of Law 14/2013 permits, the switch is possible when the conditions of the current permit have changed. This event is checked first.

⚠A separate restriction: you cannot request an employment permit with the same employer or group of companies that gave the basis for your current Law 14/2013 permit.

Non-lucrative residence and employment by a foreign company on a nomad visa. One plus four — the same five years to permanent residence. In the first year — autónomo only and only the declared activity.

Where it breaks: the permit only takes effect after Social Security registration — you get a month for it. Miss it and the approval stays on paper.

There are more scenarios: redundancy from a highly qualified professional card, divorce, finishing studies (no one-year requirement, but the first card is for a year), arraigo.

The province matters more than the documents

Criteria aren’t published and differ between regions. Pick yours — it flows into the check, dates and plan. Data as of August 2026.

By law the authority has three months to decide, but this is regularly exceeded. Plan by your province, not by the average.

✓A red province is not a verdict. The case is decided by the province where you are registered. A legal move changes the authority: approvals come from Asturias instead of Valencia, from Tarragona instead of Alicante. This means a real change of residence done properly — not a registration “on paper”.

How much money to show for Cuenta Propia: calculator

There is no income threshold. What’s checked instead: whether you have enough to live on and whether the investment fits the project. Low turnover in the first year is not a problem — an empty account is.

⚠These figures are not in the law. It only speaks of “sufficient means”. The 600 € comes from IPREM by analogy with other permits: 150% IPREM — 900 € for you and your spouse, plus 300 € for each additional family member. Your province may count differently, so plan with a margin. If you are already registered as autónomo, tax and Social Security returns and certificates replace the bank statement.

The Cuenta Propia business plan: the document that decides

15–30 pages, not 150. It is read by a civil servant with no business experience — the task is to make the project clear to them.

What must not be there

  • Inflated numbers — a plan you won’t meet creates a problem at renewal.
  • Complex licensing if you can do without it.

Opinion of a self-employed association

ATA, UPTA, CIAE or another recognised organisation assesses whether the project is viable. Not mandatory by law, but a positive opinion answers the question “will this business support you”. About 150 €, usually about a week.

ℹWhat works best: ordinary, understandable activity — consulting, marketing, services for newcomers, coaching, crafts, a small service. The fewer licences the idea needs, the better the odds. Spanish clients, contracts and letters of intent noticeably strengthen the file.
⚠Regulated professions — doctor, dentist, physiotherapist, psychologist, nurse, pharmacist, engineer, architect, teacher, lawyer: you need recognition of your qualification and licences. Sort this out in advance, not during the application.

Some provinces require two years of the child’s residence in Spain. If that isn’t met, the mechanics are unclear — ask in advance.

⚠Order and roles are decided before filing. Main applicant first, wait for “en trámite” — then the family member. Whoever held the previous permit stays the main applicant: in one case, swapping roles led to a refusal for the spouse. Turning a colaboradora into a family member after approval means starting over.
ℹThe housing suitability report (informe de vivienda adecuada; some town halls call it suficiente) is issued only for a long-term rental contract — check the wording of your contract in advance. Timing depends on the town hall: from a week to a month; an inspector visits the flat. Start it in parallel with the business plan.

⚠Don’t mix them up: 203.84 € is often quoted for form 790-062 — that is the first-time permit rate. For a modification it is lower: if the form fills in a larger amount, the wrong section was chosen.

    How to apply for the modification: seven steps

    Remotely — through the Mercurio portal to the immigration office of your province of registration. You need a digital signature: yours or a representative’s.

      The main substantive work — usually about two weeks.

      Submitting the plan, revisions, positive opinion — about a week.

      Collecting the file

      In parallel with the plan — no-debt certificates, padrón, statements; with family — the housing report.

      Filing

      Form EX-26 and two fees: 790-052 for processing and 790-062 for the self-employment permit. Form EX-02 for each family member.

      Answering a request

      The authority gives ten days. A business plan and justification prepared with a margin let you answer fast.

    ℹThis is the general regime, not the Startup Law. The Cuenta Propia application is filed in Mercurio with fee 790-052 and decided by the provincial immigration office. The UGE portal is not used for this filing.

    What to do after your Cuenta Propia approval

    The modification changes more than your immigration status: you become autónomo — with contributions, taxes and reporting. A mistake here surfaces a year later, at renewal.

      Register as autónomo (RETA)

      A month from the approval notice. The registration type matters too: a mistake can sink your renewal even with the permit in hand. If your current permit didn’t allow work, the new one only takes effect from this registration.

      Apply for the TIE card

      Fingerprints and card within a month of registering. Fee 790-012 — 16.08 €.

    3. first year
      Keep the reduced contribution rate

      New autónomos get a reduced Social Security rate. It is easy to lose on a technicality — and then the amount is recalculated retroactively for the whole period.

      Taxes and reporting

      Quarterly returns, VAT, annual reporting. Zero returns while you are actually working lead straight to a letter from the tax agency.

      Changing your activity

      No need to notify immigration — conditions are checked at renewal. The exception is a one-year card: activity is limited to the declared one, and changing it needs a separate application.

      Watch your absences

      The permit itself has no minimum days, but for permanent residence after five years you can’t be away more than six months in a row or ten months in total.

      Renewal and permanent residence

      Renewed for four years, with no limit on renewals; the permit becomes mixed — you can work both self-employed and as an employee. What’s checked is real activity: Social Security and tax compliance. Five years of legal residence open long-term residence.

    Why modifications are refused and what to do

    A refusal is almost never about your business — it is about how you presented it. Open an item.

    ✓A refusal doesn’t take away your current permit — it stays valid until it ends. But a refusal is only workable if there is time for a second attempt. File at the last moment and there won’t be one.

    Problem
    The application had to go in as soon as the business plan got its external review — without losing time waiting.
    Solution
    The positive CIAE opinion on the business plan arrived on 21 July 2026; the application was filed the same day.
    Outcome
    Decision on 3 August 2026: permit until 2030 with the right to work both self-employed and as an employee.
    💡 Prepare the whole file in parallel with the business plan: then the association’s opinion is the last document and you file the same day.

    Startup visa: filed before the revocation took effect

    Founder of a security project on a startup visa, living in Valencia
    Problem
    A UGE letter demanded proof of company registration and activity — two weeks to respond. Valencia almost never approves modifications from the startup visa.
    Solution
    The client legally moved to Asturias, the business plan was written in two weeks and the application went in before the revocation took effect. The CIAE opinion arrived a week after filing and was added to the file.
    Outcome
    Approved a month after filing, 4-year permit, status no longer tied to UGE and ENISA.
    💡 After a UGE letter the calendar decides: the application must go in before the revocation takes effect.

    Laid off by a Spanish company: three months to act

    Problem
    The company made mass layoffs: after dismissal the permit would last three months, and years of residence towards permanent residency were at stake.
    Solution
    Filed in Tarragona, where registration was possible. Business plan in two weeks, ATA opinion in a week; the file included recommendation letters and letters of intent from future clients.
    Outcome
    Approved a month after filing, 4-year permit.
    💡 The business plan explains the key question: why someone leaves a Spanish employer to work for themselves. Without it that move is not obvious to a caseworker.

    Nomad visa instead of renewal: 4 years in 51 days

    Problem
    Renewing the nomad visa kept the tie to a foreign client and the 20% cap on Spanish clients.
    Solution
    The business plan was prepared with the client and reviewed by a self-employed association; filed on 5 August, 27 days before the card expired.
    Outcome
    Approved on 25 September 2026 — 51 days after filing, a 4-year permit.
    💡 File with a margin before the card expires: the business plan and the association’s opinion take weeks, not days.

    Family of three from a startup visa: roles swapped — and a refusal

    The startup visa was in the wife’s name, husband and child were family members; registered in Tarragona
    Problem
    The project stopped. The husband was made the main applicant for Cuenta Propia and the wife applied for family reunification — and was refused.
    Solution
    The wife reapplied as an independent applicant with her own business plan. The file included letters of intent from clients, a working landing page and active social media.
    Outcome
    Main applicant approved in 31 days (22 May → 22 June 2026), then the spouse and child. All three got 4-year permits.
    💡 The main applicant stays the main applicant: whoever held the previous permit applies as the main applicant for Cuenta Propia too.

    What is a Cuenta Propia modification in Spain?

    It is a switch from your current residence permit — the digital nomad visa, startup visa, highly qualified professional card and others — to a self-employment permit under the general regime. You apply from inside Spain, without a visa or leaving the country. You need a reason for the switch, a business plan and funds to live on.

    Can I switch to Cuenta Propia right after getting the digital nomad visa?

    No. You need a year of legal residence on your current card. You can formally apply earlier, but then other articles apply with a labour market check and the permit is granted for one year. Students are the exception: after successfully finishing their studies no year of residence is required, but the first card is for one year.

    Is it true that the modification gives four years at once?

    Yes, with two conditions at the same time: you have lived in Spain for at least a year as a resident, and your current permit allowed you to work. The digital nomad and startup visas qualify. If you had no right to work — non-lucrative residence or employment by a foreign company — the first card is for one year and four years come at renewal.

    Do I need to register as autónomo before applying for Cuenta Propia?

    No. You register as autónomo after approval, within a month of the notice. If you are already registered, it helps: tax and Social Security returns and certificates replace the bank statement and prove the activity is real.

    How much money do I need to show for Cuenta Propia?

    There is no fixed income threshold. What is checked is funds to live on — a guideline of 600 € a month for one person and 900 € for a couple, plus 300 € for each additional family member — and an investment proportionate to the project.     Is an opinion from ATA or UPTA mandatory?

    Not by law. The opinion of a self-employed association is an addition to the file — an external assessment of the project’s viability. In practice a positive opinion noticeably strengthens the case. It costs about 150 € and usually takes about a week.

    How long does a Cuenta Propia modification take?

    Three months by law, but in practice it depends on the province: two weeks to a month in Tarragona, about a month in Asturias, about three months in Alicante, six to seven months in Valencia and up to a year in Barcelona. While your case is processed you are in Spain legally.

    How much does a Cuenta Propia modification cost?

    Government fees at filing are 10.94 € on form 790-052 and 81.54 € on form 790-062 — about 92 € for the main applicant. Later, 16.08 € for the TIE card. Each family member pays 10.94 € and 16.08 €. Separately — the self-employed association opinion, about 150 €, and translations if needed.

    Do I need a criminal record certificate for the modification?

    No, unless you have left Spain for more than six months in a row. This is one of the main differences from a first application through a consulate.

    If the modification is refused, will I lose my current permit?

    No. A refusal does not cancel your current permit: it stays valid until it ends. You can reapply — there is no waiting period — appeal within a month to the same authority or within two months to court, or change route. That is why you should file with time to spare.
